Will Exxon Win Again?
Once again the nearly 33,000 victims of the 1989 Exxon Valdez oil spill disaster could see their court ordered payments cut in half. The original verdict has been already cut in half and now it would be only a fourth of what the original verdict totaled. At present the court has ordered Exxon Mobil to pay 2.5 billion dollars in punitive damages or roughly $75,000 per person. Exxon has asked the Supreme Court to cut the amount to 1 billion or roughly $33,000 per person. As of Wednesday the justices had not reached a firm conclusion, but they appeared to agree with Exxon that the 2.5 million is excessive punishment for the 1989 oil spill. Two justices, who appear to hold the balance of power in the case suggested a payout of about 1 billion might be appropriate. Because it has little to do with the legal principles that underlie the case, there wasn't much talk in court about either the Alaskan's plight, due to their dependence on the area environment for their pay checks, or the record profits Exxon has had. Although the award of 2.5 billion only represents about 3 weeks of the 11.7 billion in profits they made in the past 3 months, Exxon has fought extremely hard to knock down or erase the verdict handed down in 1994. The accident that dumped 11 million gallons of oil into Prince William Sound cause an environmental disaster that fouled 1,200 miles of Alaskan coastline and killed hundreds of thousands of seabirds and marine animals. It sad to see the little guy get crushed by the giant but it looks like once again this is going to happen. With all the money Exxon has made you'd think they could do the honorable thing, instead of steamrolling the people who lost the most in this disaster and are losing again in the latest disaster.
